Проте, аби наше партнерство було продуктивним, важливо пам’ятати про вимоги законодавства у залі судових засідань.
Минулої п’ятниці, 16 січня, під час розгляду клопотання щодо народної депутатки України виник прикрий інцидент: трансляція засідання розпочалася всупереч тимчасовій забороні головуючого судді. Хоча зрештою дозвіл і було отримано, такі ситуації забирають дорогоцінний час засідання та створюють дискомфорт для учасників процесу.
Аналогічні випадки мали місце й в Апеляційній палаті Вищого антикорупційного суду під час судових засідань щодо застосування запобіжних заходів до народних депутатів України. Зокрема, під час судових засідань 8 та 26 січня 2026 року, окремі телеканали розпочали пряму трансляцію судових засідань до надання відповідного дозволу судом.
Звертаємось до вас із нагадуванням: здійснювати пряму трансляцію судового засідання можна лише після оголошення головуючим про таку можливість. Це передбачено ст. 27 КПК України. Факт подання такого клопотання до суду або ваше фактичне перебування у залі судових засідань не надає автоматичного права на трансляцію. Рішення слідчого судді/суду про дозвіл на трансляцію — це не обмеження свободи слова, а вимога закону, обов’язкова для кожного, хто перебуває в залі.
Нехтування вказівками судді/суду може призвести до видалення із зали судових засідань.

We call media and civil society representatives to comply with legal requirements when covering court proceedings
The High Anti-Corruption Court and its Appeals Chamber are always open to cooperation with the media and civil society representatives. We sincerely appreciate your work, as it is thanks to journalists that society receives objective information about the progress of high-profile cases.
However, for our partnership to be productive, it is important to observe the requirements of the law in the courtroom.
Last Friday, 16 January, during the consideration of a motion concerning a Member of Parliament of Ukraine, an unfortunate incident occurred: the broadcast of the court hearing began contrary to the temporary prohibition imposed by the presiding judge. Although permission was eventually granted, such situations take up valuable court time and create discomfort for the participants in the proceedings.
Similar incidents have also occurred in the Appeals Chamber of the High Anti-Corruption Court during hearings on the application of preventive measures. In particular, during court hearings held on 8 and 26 January 2026, certain television channels began live broadcasts of the hearings before the court had granted the relevant permission.
We therefore remind you that live broadcasting of a court hearing is permitted only after the presiding judge announces such permission. This is stipulated in Article 27 of the Criminal Procedure Code of Ukraine. The mere fact of submitting a motion to the court or your physical presence in the courtroom does not automatically grant the right to broadcast. A decision by the investigating judge or the court to allow broadcasting is not a restriction on freedom of speech, but a legal requirement that is mandatory for everyone present in the courtroom.
Failure to comply with the instructions of the judge or the court may result in removal from the courtroom.
We highly appreciate the work of the media and civil society representatives and always strive, within our capabilities and in accordance with the law, to meet requests for coverage of court proceedings. Therefore, we call on you to cooperate and to comply with the requirements of the applicable legislation.
